These Terms and Services outline the expectations, responsibilities, and conditions for all clients engaging with our services. By contracting with Zargar Ink, you agree to the terms set forth below.
Services Overview
Zargar Ink offers marketing and communication consulting services, including but not limited to:
- Branding strategy design
- Social media campaign revamps
- Website copy updates
- Identification and training of internal marketing staff
- Other customized marketing solutions as discussed in the service proposal.
Scope of Services
- The specific services provided, deliverables, and timelines will be agreed upon and detailed in a signed Statement of Work (SOW) or contract.
- Any additional services or scope changes requested after project initiation may result in additional fees.
Fees and Payment Terms
- Payment terms, including rates, deposit requirements, and installment schedules, will be outlined in the SOW.
- Payment is due within 30 days of invoice receipt. Late payments may incur additional fees or delay in project deliverables.
- Zargar Ink reserves the right to halt work on a project if payment is significantly overdue, with prior notice.
Intellectual Property
- Zargar Ink retains copyright ownership of all templates, drafts, and unpublished works created for the project before payment is made.
- Upon final payment, clients will have exclusive rights to all finalized deliverables produced specifically for their brand.
- Unauthorized use or distribution of Zargar Ink’s proprietary materials is prohibited.
Client Responsibilities
- Clients are responsible for providing timely feedback, approvals, and any materials necessary for Zargar Ink to complete the project.
- Any delays in providing necessary materials or feedback may impact project timelines, for which Zargar Ink will not be held responsible.
Confidentiality
- Zargar Ink agrees to maintain the confidentiality of all proprietary information shared by the client.
- Both parties will not disclose confidential information to any third party without written consent, unless required by law.
Revisions and Approvals
- Zargar Ink offers up to five rounds of revisions per deliverable to ensure client satisfaction.
- Additional revisions beyond the included rounds may be charged at an hourly rate.
- Once a deliverable is approved, further revisions will incur additional fees.
Termination
- Either party may terminate the contract with 14 days’ written notice.
- If the client terminates the contract before project completion, Zargar Ink will invoice for work completed up to the date of termination.
- No refunds will be issued for completed deliverables or services rendered.
Liability Limitations
- Zargar Ink will provide services to the best of its abilities; however, we do not guarantee specific results or outcomes from marketing efforts.
- Zargar Ink is not liable for any damages, loss of revenue, or any indirect, incidental, or consequential losses arising from the services provided.
Governing Law
- These Terms and Services are governed by the laws of Ohio.
- Any disputes arising under this agreement will be resolved through arbitration or in courts of Ohio.
